1. Taraflar

ALICI: emorylunn.com üzerinden sipariş veren ve sipariş sırasında ad, soyad, e-posta ve (basılı ürünlerde) teslimat adresi bilgilerini bildiren kişi.

2. Konu

İşbu sözleşmenin konusu, ALICI'nın SATICI'ya ait emorylunn.com internet sitesi üzerinden elektronik ortamda siparişini verdiği aşağıda nitelikleri ve satış fiyatı belirtilen ürün ve hizmetlerin satışı ve teslimi ile ilgili olarak 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği hükümleri uyarınca tarafların hak ve yükümlülüklerinin belirlenmesidir.

3. Sözleşme Konusu Ürün ve Hizmetler

Ürünlerin satış fiyatı, vergiler dahil olarak sipariş anında internet sitesinde ve ödeme sayfasında gösterilen fiyattır. Basılı ürünlerde gönderim bedeli fiyata dahildir; ALICI'dan ayrıca kargo ücreti alınmaz.

4. Kişiye Özel Eserlerin Niteliği

Kişiye özel eserler, ALICI'nın bildirdiği bilgi ve anılardan esinlenerek yazılan kurgu eserlerdir. Biyografi, belgesel anlatı ya da araştırmaya dayalı tarih çalışması değildir. SATICI, ALICI'nın bildirdiği bilgilerin doğruluğunu araştırmaz veya doğrulamaz; sahne düzeni, olayların sırası ve diyaloglar edebi amaçla düzenlenebilir. ALICI'nın yazılı olarak bildirdiği isim, yer ve tarihler esere aynen işlenir.

5. Ödeme

Siparişler Payhip üzerinden verilir. Toplam tutar ve kullanılabilen ödeme yöntemleri ödeme öncesinde gösterilir; bedel peşin alınır. SATICI, kart bilgilerine erişmez ve bu bilgileri saklamaz.

6. Teslimat

Dijital içerikler ödeme sonrasında elektronik ortamda teslim edilir. Kişiye özel eserlerde teslim süresi, ALICI'nın sipariş sonrası istenen bilgileri eksiksiz göndermesinden itibaren başlar. Basılı ürünler SATICI'nın baskı iş ortağı tarafından basılarak ALICI'nın bildirdiği adrese gönderilir. SATICI, sözleşmeden kaynaklanan ifa yükümlülüğünün yerine getirilmesinin imkânsızlaştığı hallerde bu durumu öğrendiği tarihten itibaren 3 gün içinde ALICI'ya bildirir ve tahsil edilen tüm bedeli 14 gün içinde iade eder.

7. Cayma Hakkı

Türk hukukunun uygulandığı işlemlerde kural olarak 14 günlük cayma hakkı vardır. Mesafeli Sözleşmeler Yönetmeliği madde 15/1-ğ kapsamında anında teslim edilen gayrimaddi mallarda ve madde 15/1-b kapsamında tüketicinin kişisel ihtiyaçlarına göre hazırlanan mallarda ilgili istisna uygulanabilir. Yazım işinin hizmet niteliğinde olduğu hâllerde, cayma süresi dolmadan ifaya başlanması için tüketicinin önceden onayı alınır; madde 15/1-h ancak koşulları sağlanmışsa uygulanır. Sadece bu sayfayı ziyaret etmek onay sayılmaz.

Kanuni haklar saklıdır: Gönüllü iade koşulları; ayıplı, eksik veya hiç teslim edilmeyen ürün ve hizmetlere ilişkin kanuni hakları sınırlandırmaz. Alıcının mutat meskeninin bulunduğu ülkede uygulanması zorunlu tüketici koruması hükümleri saklıdır.

İade talepleri [email protected] adresine iletilir. Onaylanan iadeler, ödemenin yapıldığı kart veya hesaba 14 gün içinde yapılır.

8. Fikri Mülkiyet

Romanlar ALICI'nın kişisel kullanımı içindir; çoğaltılamaz, yeniden satılamaz, kamuya açık ortamlarda paylaşılamaz. Kişiye özel eserler ALICI'ya aittir; ALICI bunları basabilir, çoğaltabilir ve aile bireyleriyle paylaşabilir. SATICI, ALICI'nın izni olmadan kişiye özel eserleri yayımlamaz, alıntılamaz ve üçüncü kişilere göstermez.

9. Uyuşmazlıkların Çözümü

İşbu sözleşmeden doğan uyuşmazlıklarda, Ticaret Bakanlığı'nca her yıl ilan edilen parasal sınırlar dahilinde ALICI'nın yerleşim yerindeki veya işlemin yapıldığı yerdeki Tüketici Hakem Heyetleri, bu sınırları aşan durumlarda Tüketici Mahkemeleri yetkilidir.

10. Yürürlük

Siparişten önce ürün, toplam bedel, teslimat ve satıcı bilgileri ALICI'ya sunulur. İşbu sözleşme ve Ön Bilgilendirme Formu sipariş öncesinde incelemeye açık olmalıdır; kabul ve teyit ödeme akışında ayrıca alınır. Bu sayfanın yayımlanması veya ziyaret edilmesi tek başına sipariş ya da kabul oluşturmaz.

1. Parties

SELLER: see the seller details in the Turkish text above.

BUYER: the person placing an order through emorylunn.com and providing their name, email and (for printed products) delivery address.

2. Subject

This agreement sets out the rights and obligations of the parties regarding the sale and delivery of the products and services listed below, ordered electronically through emorylunn.com, under Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.

The price is the price shown, including taxes, on the website and payment page at the time of order. For printed products, postage is included; no separate shipping charge is made.

4. Nature of Custom Works

Custom works are works of fiction inspired by the information and memories the buyer provides. They are not biographies, documentary accounts or researched histories. The seller does not research or verify the information provided; the arrangement of scenes, the order of events and dialogue may be shaped for literary purposes. Names, places and dates given in writing by the buyer are used exactly as given.

5. Payment

Orders are placed through Payhip. Checkout shows the full amount and available payment methods before advance payment is taken. The seller does not access or store card details.

6. Delivery

Digital content is delivered electronically after payment. For custom works, the delivery period begins when the buyer has sent the requested information in full. Printed products are printed by the seller's printing partner and posted to the address the buyer provides. If fulfilment becomes impossible, the seller will notify the buyer within 3 days of learning of it and refund the full amount within 14 days.

7. Right of Withdrawal

Where Turkish law applies, a 14-day withdrawal right generally applies, subject to the exceptions in Article 15 of the Regulation on Distance Contracts. These include immediately delivered intangible goods (15/1-ğ) and goods made to the consumer's personal specifications (15/1-b). Where a writing commission is a service, starting it during the withdrawal period requires the consumer's prior consent; the service exception (15/1-h) applies only when its conditions are met. Visiting this page does not give that consent.

Your statutory rights remain: This voluntary refund policy does not limit remedies for faulty, incomplete or undelivered goods or services, or mandatory consumer protections applicable where you habitually reside.

The seller's voluntary refund policy, beyond what the law requires:

Novels: full refund within 30 days of purchase, no reason needed.

Custom works: full refund at any time before writing begins. Once writing has begun, no refund is given; instead, corrections to names, dates, places and the order of events are made without limit. The seller will tell the buyer the day writing begins.

Refund requests go to [email protected]. Approved refunds are returned to the original card or account within 14 days.

8. Intellectual Property

The novels are for the buyer's personal use and may not be copied, resold or shared publicly. Custom works belong to the buyer, who may print, copy and share them with family. The seller will not publish, quote or show a custom work to anyone without the buyer's permission.

9. Disputes

Disputes fall under the jurisdiction of the Consumer Arbitration Committees within the monetary limits announced annually by the Turkish Ministry of Trade, and of the Consumer Courts above those limits.

10. Effect

The product, total price, delivery and seller details must be presented before an order is placed. This agreement and the Pre-Information Form must be available before purchase, with acceptance and confirmation collected separately in checkout. Publishing or visiting this page does not itself place an order or record acceptance.
